Terms of Service Usage
We offer PSD to HTML5, PSD to Email, PSD to Bootstrap, PSD to CMS, Sketch to HTML, and Html5 Banners services.
Our additional service is PSD to HTML email template building, their modification and adjustment, development of HTML5 banners of all types, and creation of professional-looking email signatures (individually and in bulk, simple and complex) to enhance your marketing efforts.
Copyright and Work Product Ownership
TheSiteSlinger only provides “white label” service. No indication of development origin is included in the code or designs. All work produced by TheSiteSlinger is covered by copyright law. Upon payment for the Services, all copyright is transferred to the Client. TheSiteSlinger retains no rights to completed and paid work.
TheSiteSlinger does not secure third-party copyrights. All work files provided by the Client are the responsibility of the Client. Work files submitted by the Client must be original and or the Client must be in possession of the copyright. Licenses and liability related to content or third party goods/services are the sole responsibility of the Client.
On this website the base rates are displayed. Additional rates may apply upon review of the design files due to page length, complexity, and other factors. These additional rates will be communicated to the Client for approval before work commences. Changes or additions to the project after work commences are subject to additional charges. Extra charges apply for expedited delivery.
Discounts may be available on large orders, for high-volume and returned clients.
Unless otherwise provided, fees for Services are due in advance. If other payment arrangements have been agreed upon by both parties, the full amount due must be paid before delivery. If payment is not made the Client will be in default. In this case, TheSiteSlinger may take an action to remedy the default.
This includes declaring all unpaid monies immediately due and payable; terminating work; taking any other lawful action TheSiteSinger deems appropriate to enforce the Client’s obligations under these Terms of Service.
The Client agrees to pay costs and reasonable attorney’s fees that TheSiteSlinger may incur in enforcing its rights under these Terms of Service.
A full refund will be considered based on the following reasons:
— Client’s order cannot be completed;
— Client’s request to cancel the order is received before the development is started.
A partial refund will be considered based on the following reasons:
— Client is reasonably and legitimately not satisfied with the quality of the code or service and provides a comprehensive proof / explanation of the matter;
— Client is not satisfied with the resulting product upon a review on our test server. A refund may be issued upon the confirmation of both parties, and upon the clearance of all details related to the refund.
If the order is completed according to the specifications of Client, some minor errors should be deemed acceptable and cannot be a reason for full or partial refund.
Notwithstanding anything to the contrary contained herein, the transaction amount may be refunded or reversed to the Client’s payment account in case of an accidental double payment.
TheSiteSlinger will initiate the refund of the double payment amount within two (2) business days after the Client’s notice, assuming that any and all refund fees, and/or any associated fees, fines, or penalties listed in PayPal, MasterCard, Visa, American Express, Discover, and other payment card networks, associations, or companies (‘Networks’), are (i) not refundable due to the Networks’ policies and (ii) withheld from theSiteSlinger , - will not be reimbursed.
Delivery and Response Times
The pricing options displayed at TheSiteSlinger include estimated delivery times which are not a guaranteed time for delivery.
Delivery estimates are calculated using full business days. Partial days are excluded. The first business day is considered to be the first business day following payment of the invoice and finalization of work specifications. Business days are considered Monday through Friday 8am-5pm CST.
If the Client’s request was made during non-working hours or holidays, this request will be considered within the following working day.
Quotes for markup are generally provided within 2 business hours. Quotes for CMS implementation require additional time for review and are usually provided within 1 business day.
Support and Updates Policy
Bugs/errors are fixed free of charge. Bugs/errors should be reported within 30 calendar days for all CMS projects and 7 calendar days for all other projects.
TheSiteSlinger supports revisions/updates for 7 calendar days from original product delivery. For CMS projects, support extends to 30 calendar days. In the absence of feedback or other communication within the appropriate time frame, a project is considered to be complete.
Support is available for purchase at and additional cost to extend these timeframes Most revisions are provided within 1-2 business days. Updates may require additional time.
Updates to existing websites are considered as a new project subject to new specifications. Changes involving functions or design that were not part of the original project scope are also considered to be new projects. Pricing for updates and changes is based on current published pricing.
TheSiteSlinger also provides installation services at an additional charge. If TheSiteSlinger is responsible for installation, the markup or CMS theme must be finalized before the installation stage is started. Requests submitted after installation is complete may incur extra support charges.
Future maintenance is available at an additional charge.
For PSD to HTML email template building, we provide all fixes (if any) for free until the Service is accepted according to the “Acceptance” paragraph. Paid updates / changes are available upon request.
Please note that TheSiteSlinger makes commercially reasonable efforts to fix Clients' projects. It does not mean that we will refuse in fixing your project but it means that we may decline your request to fix in a case such fixing is not actually a fixing but is more likely an alteration that must be treated as a change request and is subject to extra charge.
Default acceptance criteria are applicable to all projects and all project stages. A delivery is considered accepted if:
- Client explicitly approves a delivery by any means of communication including but not limited to Client Area of this Site, email etc; or
- Client does not send any feedback/change request within fourteen (14) days for markup project and within thirty (30) days for CMS integration / development projects; or
Our goal is your satisfaction on a project. To this end, TheSiteSlinger will assist with any revisions brought to our attention under the Support and Updates policy. A refund may be available for projects TheSiteSlinger is unable to complete. A partial refund may be available if the Client is not reasonably and legitimately satisfied with the quality of the code or service and is able to provide comprehensive proof / explanation of the matter.
Please note that any calls to TheSiteSlinger may be recorded for training and quality assurance purposes. If you do not wish to have your conversation recorded, please notify our representative when the conversation starts. Otherwise, we will presume that we have your permission for the conversation to be recorded and monitored.
TheSiteSlinger reserves the right to modify these Terms of Service at any time. The modified terms will be posted on this page. You are welcome to check here for updates. Your use of Services after a change will be considered acceptance of the modified Terms of Service.
